Hello! I have been working for a temping agency for a while, in the same job. I was recently told that there had been a mistake with the company regarding my hourly rate, which is subsequently being lowered from the 4th of Septembre. I am going to take a few days' holidays from the 4th (this was already planned), and now I'm wondering what rate this is going to be paid at. Should it be the rate I have been getting, and accrued my holiday time on, or will it be the new lower rate? I will obviously ask my agency, but would like to know where I stand now, as the question has just occured to me. Many thanks in advance!
i would expect it to be at the higher rate......but you know bosses, anything to save money so dont be surprised it is the lower rate they pay you at !!
I would have thought that if you had been paid at the incorrect rate, then you would accrue holiday at the rate you should have been paid at, which will be the lower rate.

Well, I assumed that since the change is happening on the fourth, and is not going to be retroactive, then the holiday I've accrued until then would be considered a wage, hence should be paid at the rate I was being paid previously...If I'd taken that holiday before the fourth then it would have been paid at the higher rate...I will check with my agency tomorrow, thanks for your replies!
Yes, you are right about the fact that you could have taken holiday before you were informed that your pay was incorrect. I am just wondering that as you have been paid incorrectly all this time, in effect your holiday pay is due at the correct rate of pay which is the lower rate. But of course I don't have any legal knowledge so I am only guessing!

Hi again Sue! thanks for your interest! I called my agency today, and they confirmed that my holidays will be paid at the higher rate! I'm a happy bunny... :-)
