I have been in my job for almost four years. When I first started I was contracted to work 16 hours per week. However, 16 months ago my hours increased to 32 hours per week but a new contract was never drawn up. My workplace has since changed hands and I am now told I have to revert back to my original 16 hours. Is this legal? And where do I stand.
I think that the old company knew that it was going to change hands and deliberately left out the new contract knowing that it already submitted the cotracts of employers to the new company owners. Its a shame because we see employers exploiting loopholes all the time, so next time if your employer agrees verbally to a change like that, make sure you get it in writing.
Say you need it for another purpose to save the trust arguement.
You could show your payslips to show that you had been working the 32 hours. Make your case and if the company are not prepared to be reasonable go to CAB for advice. The new company is liable for any claims to tribunal, it's part of the TUPE transfer.
Yes. If your hours have been constant over that period then I would assume an implied contract. You need to take legal advice and quickly the clock is ticking for claims to tribunal.
