i'm off sick from work

currenty off sick with work related depression,my annual leave is coming up,i'm going away to france, i will be handing in a sick note to cover the 2 weeks i'm away,can my employer stop me going away?

Not sure if each company has its own policy but I know that with my company i'm not allowed to go on holiday if i'm off sick.

I work for a local council and their policy is, IF you are off sick, then you must not take annual leave. You must return to work before you can go on holiday.
You really would have to know the terms of your contract.
i was reacently off sick for the same reason i had a four week sick note i still went on holiday. my sick note cancelled my holiday pay as you cannot recieve sick pay as well as holiday pay. i still have the 10 days holiday entitlement to take
nice work if you can get it,
of you go, carry on with your extended holiday,
If you worked for me I would let you go (permanently)
Get your doctor to write a note saying it will be beneficial to your health to have a break. I was in this position last year and I had 2 holidays during my time off without any problems at all. Have a good time
Check with your company, as thugulike says, where I work, the welfare officers actually encourage you to go on holiday if you are off sick with depression.

This has been taken advantage of a few times when people have booked holidays and then been refused the leave time off. They then went to their Dr who signed them off with depression and off the headed! (Nice if you have the guts to try it!)
But if you're going to go away on holiday and enjoy it anyway, why would you want to claim back the entitlement so that you can take it again? Fair enough if you've booked some leave and aren't planning to go away, or you plan to go away but can't due to sickness ...but you ARE having your holiday. I know that many people will disagree with me and alot of companies will give you back the entitlement but I think it's completely unfair on other staff members. I'm not suggesting that you're pulling a fast one - I have family members who suffer with depression and I know how hard it can be. However, someone where I work has recently been signed off for 'feeling low' - how ridiculous - it's too easy to get a sick note from the Dr's these days.
Too ill to work, but well enough to swan off on holiday and squeeze more of your employers hard earned cash for doing nothing eh?

Why not stay at home permanabtly, claim incapacity benefit and go the whole hog by being a victim all your life?

thanks to the ppl who gave me some good advice, as for some of the others who do not know nothing about my life and sickness why even bother to comment on this forum, dont judge me when you dont even know me.

Lextra I'm amazed at the attitude of some of the people on this site now. Years ago it used to have kind, supportive, intelligent people and I'm sure some of them are still around but the site seems to have been taken over by ignorant bigots. Nobody here knows why you have been off work or what the cause was but I do know that some of the stunts pulled by employers are beyond the pale, you only have to look at the reports of employment tribunals to realise that.

You can't take annual leave when you are off sick, it's not possible.

It is not uncommon to go away from home whilst on sick leave - convalescence, recuperation, respite.

As long as you do nothing to delay your recovery then there really is nothing your employer can complain about. The only difference is you will be on sick leave, not annual leave.

I'm sure your GP will be happy for you to go away and will see it as beneficial.
ooohhhhh look at me I'm depressed but can still go on holiday.

thuglife i agree with you about this site, judging bigots, as for being depressed thats my issue! and there is nothing wrong with my legs. appreciate the nice ppl here who gave sound advice as for the other's who seem to know me better than I do, why dont you go create a site dedicated to ppl who like to put the boot in! chow!

and whilst we dont know your circumstances, im not sure what answers you expected to your question.
your asking people in a forum that, lets assume work 40hrs + a week and work hard for their money. And youve come on this forum asking how to claim sick pay whilst on holiday.
Im not judging, but you can see their point!

lol hope you get the sack ... do you not think of the others that have to do your job ? you are on sick but you are going on holiday ? for 2 weeks ? and as for you saying dont call you when we dont now you .... it you thats going on holiday and doing a sicky ? lazy thats what you are ... hope they sake you !!!!!!!!!!!!!!
