Graduate schemes - age discrimination

I'm aware that under age new discrimination laws employers offering graduate schemes can no longer stop those who have been out of education for over 2 years from applying for a grad scheme or development programme.
In practice though, are applications from graduates who have been outside of study for over 2 years likely be considered seriously or not? I'm 24 and graduated in 2005 and want to apply for graduate schemes to start in 2008 which will means i'll have been out of education for 3 years.
