Hi, I started a new job 5 weeks ago, at the interview I was asked if I had any holidays booked to which I told them I had 2 weeks already booked (I am going on Wednesday 16th July). When they offered me the job the manager of the office told me that I was only entitled to 1 week holiday but she would honour two weeks and just not tell their head office (who sorts out pay etc), she also told me that if I left the company AFTER the holidays had been taken then she would have to take a weeks pay off me. None of the above has been put in writing, so if I left the company after my holidays, would they legally be able to take 1 week pay off me?
Well I wouldn't be asking if I knew the answer (god some people are so rude). Can anyone else answer the question: Can they pay me and then request the money back??
iits the same as if you leave part way through a year and have taken too much holiday for the proportionate amount of time you have been there - they will either ask for the time or money back

Agree absolutely with Buildersmate - it seems rather unethical to want to be paid for work you have not done. It may be however that Kirsty means, what should she do if committed to a holiday that could not be put off for whatever reason - in which case discuss with line manager and ask to take unpaid leave. Of course, the boss is entitled to refuse this request, so be nice and don't try any fast moves on them in the first place.
