Please can someone help me with this one. I drive a van on a sandwich round for a living. Today the van started playing up, the clutch is going, i called my boss who told me just limp round and he would sort it out when i got back. He is now saying that he cant get it fixed until tomorrow evening, and so i have to take it out tommorrow.
When i told him i wasnt happy to drive it, (i work about 1/2 hour away from the depot, & have to go on the motorway) he said to either do as he says, or not to bother turning in, and face the consequences. this cant be legal can it?

I don't know the legal answer but I would be inclined to go out on the round with my mobile and when it conks out phone him to get him to come and get you and finish off the round. He will then see how daft he was...
As the driver, you are responsible for the safety of the vehicle whilst it's on the road and you are the one who would be prosecuted if it caused an accident due its being unroadworthy. However I'm not sure sure whether a faulty clutch represents any actual danger.

Arm yourself with warm clothing and survival gear and go out on your round tomorrow. If it breaks down, phone him and tell him so, and ask him to get you towed back. If he refuses, then lock it up and get yourself home via taxi - making sure he gets the bill, of course. If you're on the motorway when it breaks down, call the police and tell them you're stranded. You won't be in trouble with them. Your boss, however ...
Buy your own van, make your own sandwiches and deliver them to where he can't go , due to faulty van. Or as my 'not too subtle' daughter would say, "Tell him to ram it"
