Ultimately, if this is the case, the OP will pay for an insurance policy and assuming liability against his employers is established the employer's insurance company will pay the OP's damages and costs (including the insurance policy fee). Consequently, it should not cost the OP anything and he will receive 100% of the damages awarded (if any).
There is usually quite a wide band of payments. I know in the case of a whiplash injury you could get as little as £1500 and it goes up to about £3000. When my nephew made a claim he eventually got £1500, but when I made one I got 2,250 and my husband got £2500. It varies according to the severity of the injury. It takes absolutely ages to go through and you have to see a specialist to make sure you are not faking it. The lawyers expenses are paid by the other side if they win. You do not know anything about that, so when they say you get 100% they mean it. It is not taken out of your payment. Personally, I think that unless you are going to get a huge payment the stress is just not worth it.
What I'm saying is compensation should only be for lost earnings or future lost earnings from being unable to work and only an amount you would have reasonably expected to earn in that period of time. Also any costs incurred through change of lifestyle due to injuries, for example housing modifications or changes that are needed.
i had to have an operation on my back and was off work for 2 weeks. i wasnt allowed more time off as im a manager and i had to go back to support my team.
i think compensation is rightfully owed. ive suffered ever single waking day for over 18 months with this back injury due to works fault. poor staff training caused this accident. so why shouldnt they pay out? Ive travelled over 200 miles in total over 18 months to drs. hospitals. picking up meds. sick notes.. etc... not to mention the time off my family took to look after me and drive me to hospitals when i couldnt walk. so im sorry. but i AM entitled to money NOT just loss of earnings. i think whiplash on the other hand is a con for insurance payouts.
