Recovering Debt From Deceased!
25 Answers
Greetings each.
I loaned an old friend around £470 last year and he was repaying me in instalments.
Unfortunately he passed away in March with around £150 still outstanding.
I don't believe he made a Will, although his relatives are administering his "estate", or lack of it!
I also don't believe he had much cash at the time: certainly not enough to cover the outstanding debt.
I intend to write to the relatives to see if any money is available BUT: In the event there isn't can I legally claim against them?
Many thanks.
Be good!
Cheers.

If, for example, they had savings before initiating their claim then why would he/she not be entitled to the benefit? That would suggest that an individual who squandered their income could have the benefit, but someone who saved some of their money could not? Think about that, I don't think you'll find that fair.
Squidge - you've got your answer in terms of what you can do to get this money back. I have to say though that morally at least, if this person was indeed an old friend I would let it go. Indeed, living on the sliver of every last penny cannot be an easy thing. On the other hand 70% of the loan has been paid back and as stated, many people do not keep to their word and pay back loans from friends and relatives.

Greetings fellow sufferers.
I have avoided this forum for a while after receiving a couple of personal attacks on my character and integrity. These have fortunately now been removed.
I thank you all for your input but, after considering your responses I think it is better that I now abandon further attempts to recover this debt.
The amount of hassle and general unpleasantness which will likely be encountered are simply not worth it as I have already had enough problems with the deceased's family already: It's a long story.
If you are all in agreement I propose that we all consider the matter now closed.
Many thanks to all.
