Will Wars
well things are kicking of just as we expected. step father lin law has one blood son and they fell out about 13 years ago and never spoke since, before this f.i.l's will stated everything going to son but mother in law can live in house until she dies. house and bank accounts all in f.i.l's sole name. when f.i.l. was diagnosed with cancer a year ago he changed his will and left everything to my OH (his step son) my OH is also now lasting power of attorney, he also gifted OH quite a large sum of money 8 months ago. now my OH has had a fall out with his own brother and mother and this brother has now told f.i.l's blood son that the will has been changed. he is now seeking legal advise to have the will contested, even though it was done with a solicitor and witnessed and at the time he was of sound mind. the poor man is not dead yet and the vultures are coming out. this son who has told blood son declined to tell him that he went to the cash machine over a few days and withdrew £4k which after a lot of arguments he has now paid back into account. his mother obviously gave him the card and pin number, maybe now we should dob him into the police??? what are the chances of the will being overturned/contested?

if the will is correctly drawn up according to the current legislation - see other postings on provision for dependants (1975 act) which is after all why you pay solicitors to draw up wills....
then very little.
and in any case there is nothing to be done until the poor fella dies.

his mother obviously gave him the card and pin number, maybe now we should dob him into the police???
They won't be in the slightest bit interested - it's against the card's T&C but not a crime

approaching zero of it being overturned - sounds like it might be quite high of it being contested, but approaching zero of that contest being successful

blood son is now contesting the POA. Surley taking someones money is fraud, although mother gave him card and must know PIN number, probably because she watched her hubby tap it in many times, then this is obtaining money by deception, it was not her money to take! our lawyer as even said the only one who will benefit if the will gets contested are the lawyers.
