College Will Not Give Me A Progress Report

I am divorced from my wife and I pay maintenance for my 18.5 yr old daughter who is registered at college but dosen't attend.
I have asked the college for a progress report and they refuse me saying that I am not next of kin.
I am her biological father.

I think the collage can only have one person registered as next of kin so in your case I assume that the mother is registered. Why not ask her for a copy of the report ? But then you say 'she does not attend' so how can there be a progress report ? It could only confirm that as she has not attended.

Bizarre. It may simply be that the college has 'next of kin' on your daughter's record, meaning the person to contact in the event of emergency who is next of kin. I have had this ; my daughter's school only had my wife as next of kin, so when my daughter was taken to hospital, her mother got a tactless phone call beginning 'Mrs Puli, are you next of kin?', which caused her to think our daughter must have died. Poor old Dad never got a look in.

Just contact them asking whether they want a birth certificate and marriage certificate to prove that you are literally next of kin, have been established as legally someone with parental responsibility and have a certain interest in your daughter's welfare. A divorce does not alter biology.

I think the non-attendance is the point Eddie.
You only have to pay maintenance for children over 18 if they are in full time education.

Your daughter is an adult. You do not have custody. Why are you still paying maintenance? Call me innocent but I thought you didn't have to after 18. If this is the case, then removing the maintenance may motivate your wife and daughter to give you a progress report (although how there can be one when she is not attending is beyond me!)

I have a feeling that the only person who receives notices and updates from the college at this age is the individual student. They are legally adult and responsible for their own progress.

Thanks very much for all your information, in fact I have found that my ex did receive such a document but will not pass it over to me, also my ex is claiming child allowance for her, is this right?

Eddie, they can have more than one as next of kin and will send reports to two different addresses.

Did you phone them? You could have been anyone if you are not on her records.

If you mean child benefit - it depends on when she last attended, if she is going back for any exams or if she intends to return at any point.

Anyway...as she's over 18 no-one has the right to request her details.

Yes , I did not think of the legal aspect of maintenance. After 18 you only are obliged to pay if the child is in 'full time education' your daughter does not go to college but is just registered there.
I suspect your ex-wife does not want to loose the maintenance money so she is telling you the daughter still goes to collage. You need to find out more and stop payments if she does not attend .

I have just found out hat my ex is claiming family allowance for my daughter, as she is not attending college is this right or even legal?.
