Despite many responses on here stating that I should accept the caution, which were recommended in my best interests (original post below), I attended a Magistrates Court in East London. The case was dismissed & no fine issued, even though I did enter a guilty plea
I contested the case with no legal help. The basis of my defence was the fact that I offered to pay a fine, and if this was not acceptable then I would accept the caution. A penalty fine is a non-recordable offence, only visible via enhanced CRB. The CPS withdrew the case with immediate effect once I mentioned this to them, as an offer had been made to them to remedy the matter without court action, which they had not been notified about.
For future reference, if a fine or a caution is offered, always accept the fine, and if a caution may have implications for future work and has only been offered, then put forward an option to pay a fine, as if this is not considered, the court will not look too favourably upon the prosecuting party

Hi all embarrassed to ask for advice but here goes. I was out on the booze after work and on my way home drunk but not disorderly I decided to take a leak in a ditch on the station .it was night time and I was concealed however I was approached by two tel officers. the main officer wrote down the offence in his notebook which I signed as he stated it was a non recordable offence for police purposes.he then cautioned me and asked me to come into his room and sign a simple caution letter which I refused as I was initially told by the officer initially that the offence was non recordable which the caution letter said differently. this is my first ever offence at 39 years of age. I don't know what to do apart from take legal advice. should I accept the simple caution or contest it. help

I have a lot of sympthy for you Pravstar,
I have had radiotherapy to my bladder so I dont have to get drunk to get caught short and I can tell you it is absolute hell.
Especially when they close the public lavs and then ask why are you pissing on the street.
My sympathies - no advice on the caution I am afraid.

and Baza the next time you prosecute someone for p+ssing in the street can you find out if they are disabled and if there is a bog near

Thankyou Peter, I do recall your original post too which was the only one with any sympathy. In your case you would have a lot more in your defense, I am sorry to hear about your medical problem, and hope treatment improves your condition.
It also restores a lot of faith in the Law knowing I have come out unscathed, there is no likely hood of me reoffending, the court put the fear factor in that regards.
