Credit Card Account Settled / Still Being Chased :(
Hi Good Folks of the Answerbank
I recently paid off my credit card by calling and asking for a closing balance, I paid the amount agreed and was happy to be out of debt! The bank sent me a letter confirming that my account was now closed, great!
Now 3 months later they have contacted me for the 'outstanding balance'. After much discussion, they have listened to the recording of the full conversation that took place, and agree that the final balance was agreed and paid. However, they now say that a mistake (human error) was made and that I am still liable for the balance.
I'm really aggrieved by this, They are now continuing to add monthly charges to an account this is ... closed! If anyone could anyone let me know where I stand legally it would be really appreciated, i'd much prefer to be in your debt of gratitude. I still have the letter from the bank confirming closure, but they have sent a letter stating they will no longer discuss the matter. Any advice would be really warmly received.

Write a formal letter to the bank headed "complaint". Point out that you have repaid the balance requested and that the account has been closed. Their subsequent actions are in breach of contract and contrary to their regulator's requirement that they treat customers fairly. yeah that was me Boxie I thought he would attract the attention of the contract lawyers if he re-posted here.
My own view is that a contract let us say of paying £550 for a debt of £600 is binding especially if there is a written record. But the law may have a different view. I am interested in the answer as I have paid off a third party's debt and do not wish for the debtors to come back for seconds and say now really you owe us another z thousand.

I agree with Jim, go on the front foot, start with a strongly worded letter to the individual who last sent you a correspondence followed by a statement of claim for damages and go big, tens of thousands. If they fail to answer your statement of claim in full and to your completed satisfaction. Send another reminder of it with the amount you demand. If they don't answer that then send them notice of default by which they have legally accepted your claim and you win in any case brought to court, do it by registered mail so you have evidence.

Hi, just posting the outcome for anyone else who finds themselves in this unfortunate situation... A letter was sent to the ombudsman with all the facts, letters confirming account closed etc.. and they still found in the banks favour, they did however make the bank pay £100 for the inconvenience of it all. The banks have the freedom to do as they choose, as has been played out over the past decade or so. The common man are merely here to serve them.
