Hi,

If a toilt in a rented property stops working properly ie: stops flushig or filling up, who is responsible for fixing it?

Is it the LL or tenant?

Landlord. This should be clearly described in the tenancy agreement - the toilet is part of the landlord's fixtures and fittings. You wouldn't take it with you when you move out.

We usually fix things like this for tenants, the exception being when people do stupid things to cause it themselves, but generally it's a landlords responsibility.

If you have blocked it up by putting stuff down there other than human waste then you should pay for it. Anything else, LL pays.

Under tenant's responsibilities it says "Making good any damage to the property caused by the behaviour or negligence of the tenant ..."

I had a tenant who just put anything he didn't want down the loo and blocked it up. He had to pay for a plumber to come out and fix it. There was nothing wrong with it, just a stupid tenant - did it more than once.

cassa - from your description this seems like a fault in the cistern. If so, it is definitely the landlord's responsibility. He/she has a legal duty (which cannot be passed over to the tenant) to maintain the sanitation system (as well as various other parts of the property).
