Section 8 Notice
I want to go down the Section 8 notice route to evict a tenant. Grounds are 3 months 1 week outstanding rent which are covered by 2 grounds under Section 8.
I would like to know what pre-action I would need to take, I was reading somewhere that I need to take 2 months informal action before this. I sent letters which I have copies of , last in December but did not pursue this after as my father passed away.
I have recently issued a letter (5.8.14)which the tenant signed, stating that there are 3 months 1 week rent in arrears. I am just seeking advice as to how to proceed in terms of pre-notice procedure. Would I have to give him 2 months informal notice?

For more on marking an answer as the "Best Answer", please visit our FAQ.There seems to be some confusion here. The only time a two month time limit is relevant is when a Section 21 notice issued, not when a Section 8 notice is used.

I think it is fourteen days innit - for rent arrears ?
There is a prescribed form to be found
Fill it out
bung in the date on p2
and deliver it to him and make sure the dates are right.
then wait 14 d
The tricky bit - but it doesnt look as tho he is gonna defend the action -is that in your claim - which you now do on PCOL.... you must in your claim script put in - I wissh to evict on ground 8 to wit rent arrears....
this is construed strictly ( and I didnt, but the defendant/tenant didnt turn up )
PCOL now you can tack on an action for rent arrears.
