i was acouncil tenent for 13yrs before i met my husband when we married i decided that i wanted to buy my council property he didnt so i went ahead in my name only and recvd full discount onthis i think it was 75% he then decided after a while ayr i think he wanted to come in on it foolishly i added his name now its in joint names we have been married 11yrs but are now divorsing he wants the property sold and for it to be split 50-50 am i right in thinking as im sure iv seen it somewhere that the discount has to be taken into account in my favour so less this off of his settlement cant afford to buy him out

count yourself lucky you got to live in a council property for 13 years and then they gave you such a huge discount on the place !
Janine - she hasnt broken the law and I think this old chestnut has been hammered for a long time now.

Charly - I am not sure if this is the case. However, its certainly something you can take up with your solicitor as it may be seen as the deposit that would have been paid i.e. the discount.

You could buy his share of the house.
I think the discount will be seen as your deposit..anyone feel free to correct me if I am wrong!

As you are married and joint tenants (unless you are tenants in common?) I would imagine that your husband would be entitled to 50%. If it were the other way round I am sure you would expect the same?
