my ex wife asked for a full financial disclosure before she would sign a clean break so i provided my solicitor and also in return asked for hers.She has ignored all legal parties and her solicitor has now closed her file as they are not able to contact her.i am now going to court to apply for a clean break order myself....my question is WILL THE COURTS MAKE MY EX WIFE PROVIDE HER FINANCIAL DISCLOSURE AND ASK WHY SHE HAS IGNORED ALL LEGAL PARTIES or WILL THEY JUST ISSUE THE CLEAN BREAK ORDER.
This is why you are employing a solicitor - to help you with this. What's the point in then asking AB for an opinion when we have considerably less facts at our disposal then your solicitor.
I will suggest you swear an affidavit to that effect, attach all the evidence i.e. evidence of letters posted to her etc and make an application to the court. The judge will read the notes and review your documents and grant the clean break up. My ex wife did a similar thing and I was able to get a financial order. Remember the courts rely on evidence.

But how come you are doing a clean break after you are divorced, as you are calling her your ex wife. Shouldn't that have all been sorted out at the time of the divorce ??
thankyou for your advice and YES we have evidence,letters emails from my previous solicitor stating she has delayed and now ignoring all legal parties and also an email from her solicitor to say the same........... i have now applied to court.....................
