Traffic accident dispute.

My son was involved in a road accident which was the other driver's fault. The other driver offered a 50/50 settlement which my son rejected outright. The other driver has now changed his story so the case is going to the County Court. All logic points to my son's version being correct but we are concerned about what will happen on the day - is it decided on the weight of probability, or is the judge likely to take the view that it's one's word against the other and order a 50/50? There were no independent witnesses. Can anyone give me the benefit of their experience?

Are the Insurance companies involved? What do they say?

Our insurance company has essentially provided the solicitor and barrister for the case - they haven't commented as such. We assume his insurance company has done likewise, but we don't know what he said in his initial account to his insurance Co.
I'm not seeking people's opinions on the case (which is why I've not gone into great detail), just whether they can give any pointers as to what actually happens in court and how the judge's decision will be reached.

in my experience,without witnesses,the judge will order a 50/50 outcome,unless your son can convince him it was the other drivers fault,did he take pics of the accident,but in the end its his word against the other party,who has brought the action to court.
