my sister has been living at my nans council house for 9 months now. nan passed away 3 months ago and because my sis and her 8 month old baby was not living there 12 months they are seeking a court order to get her out even tho the council has issued her a rent card in my sisters name. can they do this and is there a way she can keep the house?

There are rules about who can succeed to the tenancy of a council house, & I very much doubt whether a grandchild can.

However, as your sister has a child the Council would have a duty to house her, subject to certain conditions. This ought to have been explained to her & she should see the Council's Housing Needs Dept. as a potentially homeless person.
Being homeless would not enttitle her to take over the tencancy, but the council may use their discretion in the circumstances. They may rehouse her in B&B accomodation. As themas says, talk to the Council
The council may well have rights to get your sister out if the accomodation is more than she needs ~ is it a 3 bedroom property?
