I share a party wall with next doors ,there is a dwarf wall with a fence on top.The apple tree in thier garden grows through the fence and back again,they have doctored the fence to cope with the trunk on my side of the boundry.
If i cut the trunk on my side of the fence the trunk will snap am i setting my self up for trouble if i cut it and put a new fence pannel in its place, Ther is no presservation order on the tree. It got a bit messy when i asked them to cut the trunk off .And we all ended up at meadeatiom which has,ent worked.

speak to them and say it is their tree spanning form their property, they must pay for upkeep of their tree on your side ie errecting fence etc

you are well within your rights to saw through the tree on your side,

write them a letter and send a copy to your local council saying it is ruining the view of your garden ensure you make your intentions clear ie 28 days to errect a proper fence or you will have no alternative to cut the half on your side of the boundry and exert preassure on the tree from your side to make it fall to their garden as it is their tree,

ensure you make a cc note on the letter to say you have sent it to council etc

if not find a vandal give him a can of petrol and matches, and usually a bottle of vodka

You've put this within legal, so I'll reply in 'legal'.
You are within your rights to remove the offending portion of any tree that grows onto your side of the boundary. So legally you are in the right.
However whether this is really worth pursuing is your decision. If you have been to mediation and failed to agree, then you have to ask yourself whether this is worth pursuing versus the undoubted relationship breakdown that is likely to occur.
Just ask yourself how much pain this is actually giving you.

The first response appeared whilst I was replying. There is no point involving the council - this is a domestic issue and the tree does not cause a statutory nuisance, unless the properties are owned by the council and you are tenants. So they won't want to know.

Why do you want to cut the tree down? Because you dont like your neighbours? Great attitude, why dont you smash their windows and **** on their lawn while you're at it.

Alternatively, grow up, get a life, apologise to your neghbours for all the grief you've given them in the past and wind your neck in.
