How do i go about filing for divorce? Do we have to be separated for up to 2 years then proceed? There are no grounds for adultery just a mutual decision (we have been married for 2 years now). Any advise greatefully accepted.

hi there, first this would depend in were you live. you can do the divorce yourselves and works out cheaper go to your local court to get the divorce papers. Do be careful if there are children within the marriage. Best of luck

As I understand it in the UK, unless there is a reason such as adultery cited then you have to be separated for two years as proof that the marriage has irretrievably broken down before proceedings can start.

The alternative is unreasonable behaviour. I divorced my husband (of some years) on these grounds and he just signed to say that he did the things I gave as reasons. As behaviour does not affect financial settlement it as fairy painless - and quick. We used solicitors, it cost about �1000 each because we did not argue about anything. I imagine you could do it yourselves if you used a good guide

Unless there is unreasonable behaviour or adultery, then 2 years separation (with the consent of the other party to divorce) is needed. If there are no children & you agree on resolution of any financial issues (called ancillary matters in divorce parlance!) then you can easily do it yourself without wasting money on a solicitor. You can probably download info. from direct.gov. (but I haven't checked), & can get the forms from your local County Court. If you need help completing them the local CAB should be able to advise you.

Yes you can download the divorce forms,i have just done it,you can also download guidance forms that tell you how to fill them in,you need then to take them to your nearest county court and make a payment to them before they will proceed,not sure of the price,think it is somewhere around the �250 mark.
