I'm thinking of getting divorced early on next year, we have been separated for just over five years. I've been thinking of using the online service - no solicitors, However, there are three children to consider. There's never been any fighting etc over the children. I live pretty close to my ex so that the children can decide for themselves who/where they want to stay. A pattern formed in the way that the week was split because I work (early out the door before the children leave for school) and my ex doesn't work.. I have them over three days and he has them four days. We both support the children in our own way rather than paying each other. Their ages are (almost 18, 17 and 12)
My question is, how would this affect a quick divorce? Is there anyway that it can still be done without solicitors?
Go to your local Court-house and tell them of your plans; they will advise you. My bruv did same is local Courts himself, all before a Magistrate.....done in a month....nisi soon after.....all for 250! Even property was divided up by order of the Mag.
you can just get divorced usingthe 5 years separation ground. sounds like you have no issues that need to be resolved by the courts/solicitors which would usually be resolved in"ancillary relief proceedings" i.e. financial relief. If everything is ok then no worries. if you wanted to resolve property issues/pension matters/ your maintenance etc then i would say go get a solicitor. if its just childrens maintenence that was a problem then he shoudl pay 25% (csa guidelines) if you had residence but sounds like you seem to operate joint residence andjoint funding so no need to make any applications. divorce is not affected by childrens matters but may affect your own rights against hubby.
