Hello, does anyone know if i can get some sort of legal documents to prove to the council (i have made a housing application) that i have no right to the property owned by my husband since there is no equity in the house, nor is my name on the property or mortgage so it is pointless going to court since i will have no share bcoz thers no equity basically the council still wont approve my application for housing despite having proof theres no equity.What can be done without resorting to a divorce which could take years?

It would apply in the same way as if you and your husband were divorcing and selling the house with equity in it - the courts would most likely award you a percentage of the house if it needed to be sold. Effectively, if the council were to approve your application because there is no equity in your house, they'd have to do this for everyone (whether single or married) who simply want to sell their property because they have no equity and wish to rent. There are many people in the negative equity situation at the moment but they're having to sit tight and ride it out. Your best bet is to rent somewhere privately for a while and re-approach the council at a later date. I don't think that even divorcing your husband would make the council accept your application.
scoobydoo, thanks that makes sense now but the other question is then how about if i get a judicial separation because your finances are sorted out for you by the court, the only difference is that u r still legally married that way i can give them a court document stating that i have no interest in the house. Their main concern they have said is the interest in the property because we are married and only physically separated.
