Change fo Location - Small Claim
I was wondering if anyone could tell me under what circumstances can I (as the claimant) ask for a small claim case to be transferred to a court more local to me.
It has been automatically transferred to the defendants home court which is 120 miles away. The cost of me travelling there by train will eat into any award I might win, and I have no back-up childcare for a day away.

This is normally what causes the case to be transferred to the defendant's "home" court. I don't think there is anything you can do about it, but ask your local Court to confirm. Also ask them whether it is possible for you to add to your claim your travel etc. costs which occur as a result.
If it is small claims, and you are successful, you can apply to the court for your travel expenses and any loss of earnings (the latter is limited to �50 per day). Make sure you have receipts/wage slips etc with you to back this up.
If it is fast track or multi track, ask you solicitor to include your travel/loss of earning in his schedule of costs as disbursements.
