Why is a person who is taking us to a employment tribunal allowed to withdraw a statement that confirms he walked off a site.We are not allowed to use it as evidence as his solicitor said he sent it to us in error.He contradicts himself in his statement and it proves he is lying.We do have an independant witness who confirms our statement.I would have thought that if you kept changing your statement that proved you had something to hide.

if the doc has 'No prejudice' then it can't be presented; however this ruling is sometimes overlooked by JPs (tribunal officials).

Add it to your case, nonetheless - even if not referred to it would be set in officials memory.
