I have an access road over my neighbour's property and because of a slope between our gardens want to construct a gate which opens over her property to get vehicles in and out. She says it is illegal to open over her land althugh she has no objection to me driving across her property! What is the law on this?

She has no objection to you driving across because she has no choice; you have a legal easement that entitles you.
Unfortunately that doesn't extend to running gates over her land.
If the gate is 9 feet long and the slope was 1 in 9, that means the bottom of the gate being 1 foot off the ground when closed. Isn't that an acceptable solution? These are numbers I invented - it may well be much less than this.
I think the gates opening onto her land would be trespass!

Why not get a sliding gate instead of a swinging gate?
That, I concede, is an even better idea than mine.
I occationaly come up with a goodun :)

Thanks for the comments - have tried the angled/raised gate to open inwards but the big gap at the bottom made the structure weak and gave free access to all the vermin that the dear neighbour feeds. Large established trees prevent the sliding option. Is the earlier comment re the law an opinion or fact?
