Can i claim housing benefit for a house owned by my father
i recieve housing benefit for a house which i rent from a private landlord.
he has told me that the mortgage payments for the house i am renting from him have gone up
I spoke to the council and they told me i have to cover the shortfall myself as i allready recieve the maximum ammount of benefit.
There is no way i can cover the shortfall so my father has aggreed to buy a house and let it to me (buy to let)
Will i still be able to claim housing benefit?

yes it will be ok, cos my dad and i did the same thing, as long as it is done properly with tenacy agreement and rent book and all that, and of course you have to be seen to be paying the shortfall.

because the house i already owned by my dad - or have i not said that enough times?
all he is doing is getting rent from me instead of someone else

dont actually understand that post about continuing with rent doc...but if you mean get the rent paid by housing after the hosue becomes legally mine...then anyone could do that at anytime couldnt they?
pretend they didnt own the place an get rent...?

Oh for goodness sake, I have never heard such crap.
1) Whilst the house has been "willed" to Joko, there is no guarantee she will get it. Wills are only workable if they are updated regularly. Much could happen between now and Joko's parents' deaths. (Joko - please do not take offence at this next bit, it is for illustrative purposes only). One parent could die and the other could remarry, thus invalidating the wills. Or one or both parents could need long term nursing care and need the property sold. Joko has a "spes" or "mere hope" of inheriting. Then even if she does there is the potential for inheritance tax or capital gains tax to be paid. It is clearly her parents' intention of leaving it to her, but at the moment, it is just that.
2) Whilst I can understand (to a point) the concern (although I don't understand the vitriol), can someone explain to me the difference about Joko renting a house off an unrelated landlord and claiming HB for the time when she is out of work - knowing that one day she may inherit property from her parents?
So presumably the problem will be solved if Joko moves out, rents another place off an unrelated landlord and pays her rent/HB to him that solves the problem? In the meantime, Joko's dad takes in an unrelated tenant. How on earth does that change things financially?
By the way, can someone remind me of the law that says "if you have a hope of inheriting property sometime in the future, you are not entitled to benefits"?

I do understand peoples initials beef with it...but...I think you've had to explain yourself too many times.
There is no difference between renting off a stranger or your Dad...EXCEPT..£60pw. Lol...I use to rent out the top floor of my house for £450pm.
I also rented a room to my cousin who claimed housing benefit when he started college. That was £50 a week...

Joko - some people just don't get the fact that sometimes you have to claim benefits of some kind when you would much rather be paying your own way. I am sure that you would prefer to work all the time and not have to claim anything. From a rent point of view, your dad gets a model tenant and you get a friendly landlord. We have been in the position of having to claim benefits and renting a property and people just don't realise the sort of crap hole you usually have to put up with because landlords assume that you are scum because you are on benefits. I think some people should count themselves lucky that they have been fortunate enough to have missed out on the 'fun' of the benefits system.
very true ummm...the reason is i am claiming only for a few rooms...the ones i mainly live in...i could claim for the whole house if i wanted...but its a biggish house so i have classed it just as a flat and we chose a rent accordingly...
my dad actually hasnt changed the amount in 15 years...
it is still low even for a flat though...
