right of way dilema

i live in a flat above some shops. there are 4 flats in all. one staircase leading to 2 flats and another staircase leading to the other 2. when i come down my stairs which are outside there is a concrete path that runs along the back of the shops and down a side entrance. the shops do not have back doors. when i went away for a few weeks about a year ago when i came back one of the shops had put in a back door that opened outwards and across my right of way. it says fire door on it. when i told the agents who run the flats for the owner. i was worried that when coming up to pass the door on my way out it would open and hit me straight in the face. they could not see the problem. i said i would pay to have the door move round so that it opened inwards. now they say the tenat in the shop could not carry in large items though the fire door if it opened inwards. is there any hope of being able to solve this. thanks for any replys

a fire escape door should not open inwards.

It is quite possible the Fire Authority insisted on the fire door being installed - & they must open outwards.

On the other hand, it may be that the shop owner/lessee has done it because of their own concern about escape.

Either way, I doubt there is anything you can do about it except possibly see if they will put a reinforced glass panel (has to comply with fire regulations) in the door so they can see if anyone is passing before opening it.

However, I do think you are worrying unnecessarily - the chances of them happening to open the door just when you are passing must be very remote. There are plenty of examples of outward opening doors in all sorts of situations which don't seem to cause problems.

its just a door...it must take about 2 seconds to pass it...

however, perhaps they would agree to add some sort of buzzer or bell or something to alert you that someone has turned the handle so you can either rush past or hang back...
