Probation reports

If a person is on convicted remand in prison, and is due to be sentenced early september,will they still carry out a probation report and how would it be done if he is in prison ? thanks

The judge has the discretion as to whether accept any reports. (Many people convicted of involvement in the recent riots have been sentenced 'on the day', with no reports being called for). However the fact that the person is currently on 'judge's remand' is strongly indicative that the judge will require one or more reports to be presented.

If so, a probation officer (and possibly others, such as a psychiatrist, depending upon the reports called for) will visit the person in prison to go through the report process.

Firstly it is a common misconception you can be remanded once convicted, you cant, the correct term is Judgement Respited or JR. a Probation report will be done if the Judge requests it but then the person would be refered as a sec10/3. A report will be done by probation using all available information including a possible interview and also PNC.

Thanks for your answer tigers, does this mean that the judge can sentence without a probation report ? how can he not have a report done prior to sentencing ? also what is a pcn. thanks

A PNC is a police national computer check. All offenders have one on entering prison to assist in a "CSRA" (cell sharing risk assessmnet) It contains all information on a persons criminal activities if they have one. The Judge more than likely requested a "pre sentencing report" hence section 10/3. This can be a good thing because he is askng for all or any information about someone including any difficulties at school upbringing etc and can be used to determine any mitigation.
