WILL I GO TO PRISON? please help!!

hi there ive just been found guilty in crown court after a 3day trial for possetion with intent to supply.

the last thing the judge said was im getting a custodial sentance
the last thing my barister said is your 100percent going to prison for 12-18months,

i have a pre sentance report to do this week and have my senancing on the 15th march


what happened... the police searched my car and found 193 grams of canibis in my girlfriends bag, and 3 mobile phones in her bag.

she was charged with possesion and delt with in magistraites, she got comunity order ect ect.

i was send to crown court



they traced the phones and found about 10 messages containing involvment in supply.

i said in trail the mobiles where hers and the drugs hers for personal use.

during the trail they linked the ,messeges to me and i was found guilty with possesion with intent to supply.

ive got a pre sentance report to do and ive got to be sencanced on the 15th

MY QUESTION IS (IS THERE ANY CHANCE THE PRE SENTANCE REPORT CAN MAKE THE JUDGE CHANGE HIS MIND AND SUSPEND SENTANCE)

ive got 9 other offences in my previos, nothing this bad


my intrests are metal detecting fishing snooker im just starting up a new buisness. last time i was aresswover a year ago.

i dont do drugs

the only reason i was involved in this offence was because my girlfriend was a drug user and got me into this mess

IVE SHOWED THE JUDGE LOTS OF EVIDENCE THAT I TRYED TO HELP HER DRUG ADICTION.

please could someone reply and tell me what u think?

well if the drugs were found on the girlfriend, why would they give you a bigger sentence than hers??.....also the report can influence the decision a judge will make, but please don't hold your breath, it wont influence it that much!!, just select carefully who you hang out with next time...this is not a professional opinion, its just mine. chin up!!

If that was what the Judge said then so be it. They have certain rules to keep to too.
The Judge just decides 'How Long' You MUST have had a "Guilty" verdict.

Firstly, nothing is ever 100% certain until after the pre-sentencing report.

HOWEVER, you really must be prepared for the worst-case scenario, which is as your barrister has described it. The best thing you can do now is to make provision for being in prison for 18 months - anything less than that will be a bonus...

HI, THANKS FOR REPLYS, YES I WAS FOUND GUILTY, THE JURY COULDNT DECIDE FOR 2 DAYS SO IT MUST OF BEEN CLOSE, IT WAS HARD FOR THEM TO LINK THE MESSAGES TO ME, BUT IT WAS THE FACT THE CONTACT LIST ON THE PHONE WAS MY NUMBERS DAD BROTHER ECT ECT. SO AFTER 2 DAYS THEY DECIDED IT WAS MY PHONE

so,about 7 ounces of Cannabis..was it cut,and wrapped as "deals",when the Police found it?..did you have Weighing scales?..were they found..are you telling the full story?

I"m surprised at your Barrister,making such a statement,to you!

Have you served"time"in Prison.prior to this conviction?

What you do now,and up until your sentencing...is show the court,that you seriously want to mend your ways..turn up at Sentencing,looking like a model citizen,and be remorseful..don"t even mention how its your girlfriends fault youre in this mess!...in the eyes of the law,you have been found Guilty..All you can do,is play the game..and pray for a reduction in Sentence!

HI,YES ONE OFFENCE WAS POSSESION 1GRAM OF CANIBIS WHEN I WAS 16, (IM NOW 25}
AND ONE PREVIOS WAS POSSETION FOR 0.2MG OF COCAIN, BARRLY VISIBLE TO THE HUMAN EYE, WHICH WAAS FOUND IN MY CAR AFTER A PARTY, BOTH WASNT MINE, IVE NEVER DONE DRUGS IM MY LIFE JUST ALL MY FRIENDS USED TOO

I think you will have to serve the prison sentence and hope when you get out you will have learnt your mistakes in the past, good luck.

HI, sorry for the caps, and bad spelling, yes im telling the full story, it was in one lump, they raided my house found nothing. no scales nothing.
ive never been to prison, ive had a smal buisness selling strawberrys and choclate in the summer, apart from that ive had no income apart from benifit , im in debt and never had much money in my bank.

also, now theve found me guilty, do i continue to tell the pre sentance report people that it wasnt me, or shali just tell them that i did send a few texts and tryed to help my girlfriend sell some of it? im not working atm but i have a buisness restoring ferniture i can start as soon as this week.

Although not a legal professional, I do have some experience of these things and I have to say that I think there's (next to) no chance that you won't get a custodial sentence. Therefore, as I said earlier, you MUST use your remaining time before sentencing to prepare for the worst and make provision for losing your liberty for several months at the very least. If, by some miracle, you escape jail, then everything else will be a bonus.

..as said here earlier..I"m afraid that the best might be,to put your "House in order"..and prepare yourself for some Spartan living conditions..might be a time to reflect,maybe join in an Education course,in the Prison,to improve basic skills..
