I was recently busted for growing weed. When police searched my attic, (no weed up there) they found my bb guns and seized them.

They would be illegal to buy now but not before 07 and i can prove they were bought legally

They are not illegal to own and you dont need a license.

They were all in boxes, not touched in years, most never even used.

I can never buy them again so really want them back. Can they destroy them because they feel like it or do they need to hold onto them until judge says they can seize and destroy them.

I have a bad feeling they will keep them for their gun amnesty campaign.

Do they have any legal right to keep them. Like i said. Bought legally, owned legally. Kept in boxes out the way in the attic. Thanks

Bluey, if they were bought legally and it is still ok to legally keep them, there is no reason why they should not return them to you. Perhaps they have taken them away as a precaution to check and make sure for certain they are actually just BB guns?
What did the officer say when they were there about their reasons or were you not present when they took them?
I think its probably illegal to keep them now and they at risk of being seized if not surrendered. Unless you are a member of a club with all the additional licneces and paperwork necessary.



If they are pistols then probably illegal. Im assuming you are in UK as the term "BB" is usually used in the USA. If you are in UK and the they are rifles then you should get them back.

Although looking on Amazon Amazon.co.uk User Recommendation they look like a bit more than kids toys. Why are they for sale on amazon if they are ilegal to buy?
Roy, are you sure of that? I have owned many air rifles none of them were toys and pretty much could kill a man, some you do need a licence for, depending on the power. In the USA all air guns are called BB guns.
Every kid around here had one once upon a time.
But quite possibly the poster is from the USA.
Air rifles and BB guns are totally different, I own both, one fires lead pellets and yes could kill, the other fires plastic balls and can not kill no matter how close you are shot with it!
I have no idea of USA laws concerning BB guns, I think in the USA they seem to think all guns are toys!
I think this may be UK as the law did change here in 2007 (although Bluey has spelt LICENCE as LICENSE which is the US spelling so I may be wrong.

You must be 18 years old or over and be a member of a soft-air club to buy and possess a realistic BB gun.
If you are not a member of a soft-air club, but still over 18 years old, you can only purchase a non-realistic BB gun, which will be manufactured in an obscure colour (pink, yellow, etc.).
If you are under 18 years old, you can only possess a BB gun on private land.
BB guns (which fire ball bearings or plastic pellets) are often played with as toys but remember they are not toys and they can be very dangerous and, potentially, could seriously injure or kill someone.

You must remember that a BB gun is considered to be an imitation firearm, which is defined as:

"any thing which has the appearance of being a firearm whether or not it is capable of discharging any shot, bullet or missile”.

It is illegal to carry an imitation firearm in public and the consequences could be very serious. If you carry a BB gun in a public place, you are potentially risking your life if someone sees it and calls the police.

I had no idea the law had changed, better get rid of the BB gun then!
Frank... "could seriously injure or kill someone." Like I said, I have owned airguns and other guns including, shotguns and firearms for most of my life, BB is just another air gun, originally they fired Ball Bearings hence "BB"

However, I havent owned an airgun now for a few years and not aware of any recent changes in the law.
I recall a teenager being shot and killed with an air rifle in New Zealand sometime last year. Definitely not toys.
An air rifle is not a BB gun, Brinjal.

Hi, i am in the uk. They are real looking, but fire plastic pellets, not metal ones. I wasmt carrying then around, they were seized in a seperate investigation. I understand there are hurdles when buying one, but owning one i am not sure. Thanks for amswers
