What would be the consequences of committing mortgage fraud ie knowingly not declaring on the mortgage application that you already have a mortgage on a property which is in arrears and negative equity, not giving this address on the application form as you have not lived there for a number of years (being let out) and the address you put on the application is the address of the property you have been renting from someone for 3 years.

if you are using the same name on both mortgages,the chances are that they will find out about the first mortgage,in their status and credit check anyhow.
The circumstances you describe constitute 'obtaining a money transfer by deception', under Section 15A of the Theft Act 1968.

The maximum penalty for this offence is 10 years imprisonment.

Thanks for your replies. It's not me who has committed this offence, but as you say normanthedog, the chances are that the names etc would come up on the credit checks, but they never did. So really he got away with it. But the guy who did it is now involved in a legal battle and all this is going to come out in court. So I suppose he should be worried!!!!!
