I have had it confirmed by the Information Commissioners Office that a 'pensioned off' member of a local bank has breached the criminal provisions contained in sec 55 1 a of the act.
They have now written to this person outling these details and reminding her of her duty of confidence towards the bank and customers. They will not be prosecuting her her as they think this would be excessive and not in the public interest. Would this be a matter for the police or would they take the same view as the ICO.

If I remembered rightly this ex-employee discussed your banking affairs with a third party and gave evidence in court regarding your finances.

The police would take the same view as the ICO - in fact would probably be guided by them.

Doesn't stop you reporting it though.
