The US embassy site includes the following:
Under United States visa law people who have been arrested at anytime are not eligible to travel visa free under the Visa Waiver Program(VWP); they are required to apply for visas before traveling. If the arrest resulted in a conviction, the individual may require a special restricted visa in order to travel. The Rehabilitation of Offenders Act does not apply to United States visa law. Therefore, even travelers with a spent conviction are not eligible to travel visa free; they must apply for visas.

Thus I suggest you contact the embassy to get the definitive answer
i was arrested for stuff like drunkeness and breaking and entering when i was 14. when i turend 15 i flew out to usa, with a 6 month visa. nothing was ever said.
so it was fine with me.
also, my step brother has been arrested tooo many times and he goes out to the U.S every year for at least 4 months a time. (his dad is out there)

Because although a good answer - not what hayleyk wanted to hear, I suspect......lol.

Hayley...............what is your Criminal Record for? How long ago etc? A bit more info. may result in someone (Chris maybe) advising you that the crime doesn't involve Moral Torpitude (however that's spelt) and that you should keep schtum and enter via the Visa Waiver.
