my friend was involved with gang fighting, what actually happened was that one night out him and his mates about 4 of them altogether decided to fight this one guy! They beat him up and when he was down on the ground he was kicked in the head.The man who was attacked pressed charges and so now all of these 4 were taken to the police station and given interviews etc. They dont exactly know yet what is going to happen to them, They think they are looking to go to prison for 6 months and serve 3 of these months. can someone please help me out on what they think will happen and do you think they will definately get sent down for 6 months?????
p.s apparently this guy they attacked is in the army and so apparently the police have seen it as attacking somebody who serves the queen!I was just wondering what others think will happen? and some more information on what category this type of assault falls into??? thankyou very much for your time.

thanks very much wizard 66 i appreciate your comment it was helpful, at least some users can make a half decent comment unlike some!!!if you dont mind me asking what did you go to prison for and how come you only served 8 months???
What were the injuries? This doesn't sound the kind of assault which is going to end in the magistrates' court. Four on to one victim, kicking him in the head ? People can get killed or very seriously injured by that and it's hard to argue that these four didn't intend serious injury, whatever the result in fact . Nasty, by any reckoning. It depends what view the Crown Prosecution Service takes, but it doesn't look the kind if case where they'll be charitable when deciding on the appropriate charges.Six months sounds an optimistic estimate.

I'm prepared to accept he's innocent until proven guilty, nothing more.
This is a 4 onto 1 fight you're talking about, speaking as someone who many times has been in a situation whereby I've had to battle singlehandedly against gangs of youths. I once dragged a black kid out from a race hate mob (good 10-15 of em) on Breck Road, only last January I was caught up in a knife fight on Warbreck Moor nothing to do with me at all. Just trying to make a living, driving a bus, there are many many more I could tell you about.
Is he sorry for what he's done, or sorry for himself because he got caught?

Thanks Wiz, that's part of the problem that McNeil does'nt comprehend (it's quite hard unless you've been there) I deal with these gangs week in week out, I see em hanging round the shops on Lower Breck, they swagger on the bus like they're unimpeachable many years ago I got a gang these scr0tes on and I had to get assistance, the bus inspector's came and what this mob were'nt gonna do to us is'nt worth mentioning after a bit of persuasion they left but not without smashing the saloon door on the bus (a Leyland Titan for the truly curious) and off they ran the inspector grabbed one of them right outside the florists on Stanley Road by the New Strand and put him back onto the bus. He was crying like a baby (grinning like a Cheshire cat 30 seconds earlier) to cut a long story short I had to go to Marsh Lane nick and tell them the inspector did'nt assault him. I felt so strongly about it I did it in my own time, and as a good union man that's something I don't often do.

If it's been sent to Crown, it's unlikely to be under 12 months. Magistrates could have done that themselves.

My Uncle (more like a brother) was murdered by a man who tied him to a chair with a washing line, poured petrol over him and then set him on fire. He had also locked the back door so he wouldnt be able to get out. It took three hours for him to die and his nylon clothes melted into his skin. The man had previously served a 15 year jail term for Firearms, Murder and Rape.

When the man came out of prison, I planned to kill him right to detail. I beleived in a life for a life ! And was quite prepared to do life in memory of my Uncle.

I bought a meat cleaver, (well it was part of a set that I bought for my kitchen) went to the mans house, tied him up, chopped his head off and kicked it up the street he lived on. The one thing that really surprised me was how much blood came out of his neck and how big the brain actually is.

I was charged with Murder but given Bail with certain conditions. I pleaded Guilty and told the Court every last detail of how I planned it.

The Judge ordered a PSR and a Psychologists Report.

I went back to Court and was sentenced to the following :-

1. 36 Months Supervision.
2. �250.00 Costs.
3. The Think First Programme.

The Judge told my Barrister the following :-

'Shall I save you some time. I am NOT considering imposing a Custodial Sentence today as I beleive there is a lot of good in this lady. She has been very clearly traumatised by the death of her Uncle. He even asked me if I could afford the �250.00 costs.

Result and that's what I call getting away with Murder !
