could someone give me advice please
My son has been charged with section 18 with intent he bottled 2 lads after they beat up his friend . no excuses i know but would like an indication to his sentance

The Sentencing Guidelines Council provides this advice to judges:
"A sentence of 3 years� imprisonment should be regarded as a normal sentence for a deliberate wounding in which a broken glass or bottle is used as a weapon, in the absence of exceptional circumstances, even where there is a plea of guilty."

Your son's previous clean record might help to get the sentence reduced slightly from that guideline figure. My guess would be a sentence of between 18 and 30 months, with half of that time actually being served in prison. (Non-custodial sentences for GBH with intent are extremely rare, so I wouldn't want to get your hopes up too highly. However, if your son has an excellent barrister and the pre-sentence reports from the Probation service are also particularly favourable, there's just a very slim chance that he might avoid prison).

I know we are just worrying about your son.

How are they ? Were they badly cut by the broken bottle ?
Will they be scars for life ( on the face ?)

Sounds like your sons ordeal will be over and in the past in 10 years ...15 years ..20 years ...
The victims will be reminded every day they have to look in the mirror to shave.

I dont want sympathy for the situation we are in from anyone .
If you are a family who hasnt had to deal with the situation we are in it,s all a bit daunting and noone is willing to give you a firm answer where sentances are involved.
I do not expect my son to walk free I expect he to get five years but any less and he will have been fortunate ,but like the lady said the victims will have a life long sentance.
When it happened They are who I thought of first not my son he is the one who commited the crime ,But as his mother I can see the effect it has had on my family and also the victims,

hi going through a simlar thing at the moment with my family we are all very new to this aswell my nephew goes to crowm on 28 april because he was advised to pleed not guilty on the count that he acted in self defence but he has pleeded guilty for punching someone with a glass in hand and cutting him so we dont know what to expect too my e mail is [email protected] this is if you want a chat it must be tearing you apart i know how you feel have posted my story prieviously and wizard was very helpful then
lets not forget though that the so called victims had hurt someone and were attacking ,not just innocent people walking past in an unprovocated attack.but they usually arent charged for the hurt or damage they did because they came worse off in the end.i am not condoning any attack but these were thugs aslo
Out of interest gisborne = were the two people charged with beating up your sons friend?
If not then why as they had caused ABH at the possible least.
Will the whole scenario of the actions from first inception be brought before the court?

They got cautions!!!!!!!!!
Last year my son plays local football and he was headbutted and had his nose broken had to have op and that lad only got caution .Only from research into this am i finding out he should have been charged with ABH and there were both teams as witnesses.

yes the more you hear the more it gives you faith in the whole system
Lots of people have said It depends on the day!!!!!!!!
What kind of answer is that when your lifes on the line !!!!
I think you find it does depend on the day or the jury.

However whats the alternate?
Maybe the whole justice and sentance system needs to be overhauled.

Make it simple.
Murder = Life without parole.
robbery = 5 years
Rape = 15 years

At least you know what you would be getting.

Also the plead Guilty sentance reductions should be scrapped.

Is the American system real ?
I saw a TV show where guys were serving 80 years etc
The chap who recently got convicted of his 10th or 11th drink driving offence got 60 years !
Is that real or does it get reduce don appeal to something like 5 years or what ever ?
hello just a quick note hoping all is going ok at trial.if the worst happens and he ie sent down ,believe me it does get easier just be prepared and its not like it appears on corrie or emmerdale you dont get beat up everyday .tiuch wood my son has never been hurt or bullied.my thoughts are with you .please will you let us all know what happens .best wishes alison xx

Sentancing in 6 weeks
Hiya.

In my case my partner was in an altercation involving a knife. He defended himself with a piece of wood. Yes he did cause injuries to the other party but there was wrong on both sides. However no charges were brought to the other party and my partner got a 6 year sentence for a section 18, (which is under appeal). I have to stress though that where my partner was concerned it was a single blow, which was proven in the medical report. There was no forensic evidence, no dna and they were unable to identify the piece of wood that my partner had hit him with.
What i am probably trying to say is, it depends on the judge and how he is feeling and also the jury and whether they are biased or not.
Hope it all works out for you all the same, i would hate for someone else to go through what i am right now.

thank you all for your help ,
I cannot express how i feel at the moment but many of you will have been in the same situation as i find myself as a mother I have a figure in my head and any less will be good news but know he should and will be punished ,But hopefully not be made an example off . This system I feel is very unjust you can scratch someone and break their skin and almost kill someone and both carry the same charge .
Nobody profesional is willing to give you anhonest answer and these are people whos proffesion is law

very sad for you ,i know the feeling of tour heart being ripped out as you are no longer in control of helping your son/baby .for a couple of weeks tou will be counting the hours/days etc since he got sent down but IT DOES GET BETTER.you must be prepared for crying when you leave after the first visit but hopefully he will be in a good y.o.i
