Likely sentence - common assault
Hi will do brief summary of situation and wonder if anyone can advise of likely sentence if found guilty?
Charged with common assault
Received police caution for common assult in september 2007 against same vicitm
Victim = female ex-partner (we were a lesbian couple)
I did not commit this offence and have pled not guilty
Evidence is ex-partner's statement and the arresting officers statementas (they witnessed none of the alleged incident) as well as pictures of bruising to partners face - no medical evidence of injury. My ex-partner will not go to court to give evidence or provide the police with any further statement she has had enough of this situation and the poor treatment she got from the police for being gay.
It is alleged I kicked her 3 times to the face whilst on the floor - it does not state I pushed her to the floor.
We had both been drinking and her statement was given in the early hours of the morning, about 2hrs after left pub but she drank when we got home so max 1hr after she stopped drinking.
Long winded I know but without aggravating and mitigating factors I'd imagine a more accurate estimate of sentence cannot be suggested!

Common assult is not as bad so you'll be fine if its your first offence etc and you seem sorry. probabaly just get a fine
