if a defendent at crown court tells a story totally different to what he told police when questioned and charged will court accept this. this new story has been created to put him in a nuch better light and have been told this is his defence even though it bears no resemblence to what he told police
The defendant would have originally been interviewed under caution of the type:
"You do not have to say anything, but it may harm your defence if you do not mention, when questioned, something which you later rely on in court. Anything you do say may be given in evidence."
The jury is entitled to infer, if they choose, that the accused fabricated the explanation at a later date if he refused to provide the explanation during police questioning.
