Assault
2 Answers
My ex barged his way into my house and assaulted my husband and in the process caught myself. My husband had bruises on his stomach, photos prove this and I have bruises on leg and arm (no photos). My ex also tried to throw a paving flag, either through the dining room window where his children were or at me who was standing in front of the window. He assaulted my husband 7 years ago too by barging into our ex-marital home and battering him. Police said he would get a slapped wrist as never had any previous. After this incident he was arrested and bailed whereas he cannot contact me or my husband. He pleaded guilty to criminal damage re the paving flag but not guilty to assault on husband and I stating it was in self defence even though he came to our house and barged in. Trial in Magistrates Court soon. What are the odds on him being found guilty and if found guilty what is the likely charge? he has no previous, he is well known to police for fighting and has had complaints of threats made by himself to a girl recorded in 2004.

If you mean what will be his sentence that would depend on what comes out in the evidence. Magistrates do have new very strict guidelines which should mean that the punishment will be appropriate and not depend on the bench of that day.
