Assaulted- should i accept a caution? have the Police acted unfairly?
Answers
speak to a lawyer is a must.
Sounds like self defence. If this is the case, don't acept the caution. If you or your husband crossed the line from self defence to retaliation then consider accepting the caution. However, I can't see the police would gather enough evidence for a conviction of you in court. (For a caution to be issued, there needs to be enough...

What happened in the incident ? Do you know whether the police have suggested cautioning the 'other side' in this ? (The cynic in me suggests they might have! Not really ideal, though it's technically possible for both sides to be guilty of assaults in one incident )
Point is, by accepting a caution you're saying you're guilty of whatever you're cautioned for. If you're not guilty, don't accept the caution. We can't begin to say what is or could be the proper course without some account of what happened.

Thanks- My husband and I were attacked by two couples who were outside a pub(we later found out they had been asked to leave). The two men attacked my husband and the two females and a male attacked me.Someone came out and saw what was happening ,and got the pub to call the police. At this point many people had come out of the pub and become involved. We managed to get away from the scene and stop a passing police car to explain what had happened, and they took me to hospital due to the nature of my injuries. The next morning , a different officer called, and his exact words were, "I can see you were injured, there was another party taken to hospital, and another arrested. We know you were not responsible for the situation, you could complain but it seems to me it ended up a bit of a free for all, it's probably not worth it, lets just say the other party came off worse". Having never been in any situation like this we went along with the police officers reccomendations, thinking he obviously knows best, we were also still in shock. He said he would go and tell the other party of our intentions, and we would hear no more.5 weeks later a different officer rang my husbands mobile and told him we were to be arrested as the other party wanted to press charges, and named us as their attackers?? Bewildered we went the next day voluntarily to give statements. I took along a photo of my injuries and explained again what the original police officer had told us to do, and that I would like a counter complaint put in against those responsible. We were bailed pending further enquiries, when I spoke to the officer recently to get an update on the situation, he advised me he had not acted on my wishes to counter, (3 months has passed), now we are to answer bail and I have been informed that I will probably get a caution for public order offence, I feel we have been let down badly by the police and do not know what to do, any advice ?

(For a caution to be issued, there needs to be enough evidence to get a conviction if it was to go to court. A caution is an out of court disposal.)
Also, it is important for you to tell your lawyer the different sides of the police, as they seem contradictory.
