August 2008 I was arrested for assault - my flat was robbed and I went to neighbors houses to ask if they called the police. No one answered the doors except the man who lives above me - he came down to check iot out - he then went up stairs and returned with a whiskey bottle and glasses. My rent money was gone, I cried, he poured a drink - he say next to me then he put his hand on my crotch. I shot up - he locked my flat door, I tried to open it, lock was a difficult one to open at best of times. He followed me round house, I punched him, he punched me, we came to the floor, I hot him a few times, I excaped through the hole in my window. My girlfriend arrived, then police 2 mins after. I was arrested, questioned and bailed. I was to be married in December 08, police knew my whereabouts. They did not put me on wanted list as were happt I was not evading. I stayed more time in Brazil, parents came to visit, police knocked on parents saying I was wanted, sister email my mum telling her.this. The officer who I communicated with was on leave, other police never knew that I was in good comms with police. CPS made a decision to charge me whilst i was in Brazil.

All I know is it's assault, not what type?

My wife and I want to visit as a surprise for my parents in July - will I be arrested? What could i get sentence wise?

Will they take my passport? I have a family to support here, my son was born 6 weeks ago. Police know where I am.

I was arrested 8 years ago for possesion of cannabis, class c then. I was arrested 2 years ago for being drunk on streets, fined £80.

Am I in big trouble when I get back, will I get to prison?

Any advice is greatly appreciated.

Well I'm not exactly sure that my answer is going to be really of much use as it's rather difficult to say unless you gave me more information but based on the above, I'm going to need to know more, see below.

You have said that you decided to lengthen your stay in Brazil - Was this where the incident took place, or did it take place in the UK? If in the UK, is that where you live/d?
You mention being charged by CPS in Brazil, did you not get any instruction from the Brazilian Police or the CPS? ie - Bailed and given a date/time to re attend a police station in Brazil?

If you answer the above then I can answer and give you advice but at this moment on time I could only making assumptions and that is not of any use to you !!
Futher information would be also helpful not only to myself but also for any other users.

Hi - by the time the CPS made a decision I was in Brazil. I was in great comms with the police until they simply advised me to contect them upon return in which we both stopped contacting each other via email as there was nothing to be said that was not already said and they knew/know if they need to get in touch, how to do so.

The incedent occured in the U.K.

They only allow 2000 characters to respond here so I had to rehash what I originally wrote in word - I explained in great detail what happened but it wont fit in these message boxes.

Also this matter is nothing to do with the Brazilian authorities - I live here legally.

It is purelly a U.K matter.

And for the moment - I can say that due to it being in your flat, that will be in your favour but I'd really like to read the whole story before giving a final answer.
I need also just for you to say what your statement says and if you have been legally advised at the time and if so what the solicitor has said - sorry if you think that all i'm doing is asking questions but is all just to give you best possible answer and give you most suitable advice rather than being short and being unhelpful to you. And have you pressed charges against the other person mentioned - if so, what the last that you knew about what was happening - I should be able to give you a final answer after your email. Hope I hear from you soon!
