common assault
hi , im in court on tuesday for common assault on my ex partner,,,she had minor bruising and a nose bleed... im pleading not guilty on the advice of my solicitor,,she attacked me and i held her off ,,, she has admitted stabbing me in the head with a key in her statement ,,, after which i held her down by her hair because it was the only way to control her ,,, i let her up several times after she seemed to calm down but each time she attacked me again,,, she received her nose bleed in the ensuing struggle..she refused to leave my house after i kept telling her to get out,,,,she has no belongings there,but assured me she wouldnt leave till she had wonderfully fluffed me over,,,,,i have no previous record..after reading through several of these legal sites im worried about pleading not guilty and what will happen to me if im found guilty,,, so what do you think will happen ,,,,

For more on marking an answer as the "Best Answer", please visit our FAQ.she is not being prosecuted for her attack on me ... although i did make counter allegations...what im saying is true ,,, i have no reason to lie on an annonnamous web site...she has attacked me before ,,, i called the police on this occasion,,,, she tried the same trick then of playing the victim and i was almost arrested,,,,,she backed down when she was told they would arrest us both.... my solicitor is getting the log files for this occasion....this is the reason i did not call the police on this latest occasion despite threatening her that i would...
also she is saying that i shoved her against a wall first ,, then she stabbed me with a key ,,, then i attacked her over a 15 min period...this is not true... she hit me... then i held her against a wall after letting go she stabbed me with the key,,, then i pulled her to the floor by her hair as i had no idea what she had stabbed me with ,,, she has tried to use knives on me in the past,,,then each time i let her go she went for me again ,,, meaning i had to keep restraining her....each time i pulled her to the floor by her hair as this was the most effective way of avoiding her spiked boots and scratching....
i pulled her to the floor each time she attacked me,,, each time she calmed down i let her up..... as i said last time i called the police she played the victim and i was almoast arrested.... it was my house .... had i left she would have wrecked my property as she had done in the past...i stayed after previous attacks because she would cry and say how sorry she was and i would think each time would be the last,,,we used to live together and after the attack when i called the police i did leave and get my own place..
Hi I also believe you should stick to your guns and go to trial maintaining 'self defence', but in reality it comes down to one thing your word against hers. You are right the fact that you have no previous convictions gives more credence to your argument. It would help your case if she has previous convictions, or if you knew of a previous boyfriend who could comment on her violence.
