Arrested for GBH sec18 after a scuffle

I was arrested for GBH after a scuffle with my girlfriend (who is bigger than me) after an argument.
During the scuffle she pulled me over, onto her whilst i was still holding a mug in my hand which smashed (from what i'm told) on her head (this happened in a darkened room). As she had had hold of my arms whilst I was trying to get away I then ran into the utility room to look for my keys.
A neighbour had called the police and she (my girlfriend) met them with blood down her face.
My girlfriend told the police I had hit her with the mug but refused to give a statement.
The injury's are 2 cuts with bigger one just over a centimeter.
We had both been drinking, but were not "drunk".
I have various cuts, scrapes etc
I have no previous, there were no other witness.

What do you think will happen?

What do I think? I think that somebody has got something seriously wrong somewhere here. There is no way that the injuries you describe come under 'GBH'. The relevant information is in my links here:

Gives me an idea that it's pretty impossible for them to charge me with GBH.
Got a bit of time to wait yet until I answer bail, but with only my statement (saying what I said above) I don't see how they can charge me with anything?

only thing which concerns me is (i'm told) that domestic violence cases don't need the "attacked" to give a statement as they can just go ahead with it.
We both knew things were over and i'm pretty sure she feels just as I do that its better to be apart.

Joe boy - please take a look at my thread!There are many similarities apart from the fact this is a domestic situation. I was charged with GBH with intent initially and it was dropped to ABH. Numebr one thing for you is get a good solicitor - my first one was useless! I got 100hrs community service by the way after pleading guilty!

I don't really see many things the same.
With yours I see someone trying to protect his brother and approaching a situation which is already heated.
My girlfriend pulled me over on top of her. I had not gone over to intervene, it was an argument between ourselves, which had turned into a scuffle when she wouldn't let me past to get my keys.
I also assume the bouncer (in your case) put in a statement and wanted to press charges?

whatever happens throughout all of this, I have learn't that the police lie and try to play people off against each other. I used to have alot of dealings with the police in my job. I won't be so trusting.

I have to agree with Eddie. The issue here is both myself and yourself were holding the object at the time of argument (takes the premeditation issue slighly out of it). If I had purposely gone and picked up a glass and run at the bouncer then chances are I would be in jail now,however with the charge of ABH intent is largely irrelivent.The charge in your case will depend a lot on damage done and by what you say the damage is fairly similar to the damage I my case (2 small cuts). In both cases its a heated situation thats gone out of control! My solicitor kept going on about premeditation all the time and the fact that the CCTV shows me trying to intitially difuse the situation supports the fact it wasnt a planned attack!

Sorry Joe - I meant to mention - there is a guy doing community service with me who pleaded guilty to ABH on wife (not sure of injuries) and he got 200hrs and 6 mth suspended. I think but dont quote me but domestic issues (against a women) are treated sligghtly differently? I am not an expert but I have done a lot of research over last year being in the same position as yourself. All I can say is keep yourself busy as things arent normally as bad as they seem Just prepared to wait.I was arrested last August for GBH and didnt find out my actual charge of ABH until Feb! CPS are slow to say the least although my brothers involvment who is a policeman probably meant everything was done by the book andit had to be dealt with by a different CPS!

Thanks for the advise guys.
I obviously need to go around finding people with things in hands, pull them on top of me so I get injured by them and get them done for GBH or ABH.
You are forgetting 2 things
1. I didnt hit her with it
2. She won't put a statement in anyway

with all this said, and no previous history of domestic violence, my solicitor doesn't think much will happen

Whilst I’m not doubting you JoeBoy, there have been numerous threads on AnswerBank in which people charged with ’glassing’ someone in a pub/club have claimed they were simply holding a glass and it accidentally smashed against someone’s head in a scuffle. The police will hear similar claims many times and often won’t believe it. Maybe your case could fall into the same category

I agree factor - I was very lucky/unlucky whichever way you look at it that I had CCTV of the incident. The glass didnt even break in my case and I sustained breaks in the knuckles which sort of pointed towards a punching motion(fracture know as boxers break). The fact that she wont put a statement in I would say you shouldnt have much to worry about. A weapon being involved does change things and the fact that I pleaded guilty to ABH negated the issue of the weapon really!

Yes factor I see where you are coming from, although mine was a cup and in my house. Hopefully it will all get sorted out soon
