Hey on a night out in town this boy apparently hit/slapped this girl on the dance floor, later outside our friend spots the boy and 5 of us questioned him and he denied attacking her, we were pretty drunk and started attacking him, his friends defend him claiming it wasnt him, but we still attack him, we then get stopped by the police and got done for ABH

I only hit and kicked him once, and now it turns out he wasnt the boy who we were after.
I now got to go to the police station for interview, what is the likely outcome for me?

Sorry but it justabout sums you up , youl get what you deserve
jonnsta, you're a plonker and deserve more than what your sentence will be
This is a joke isn't it? Nobody could be so silly as to do this.
After all of that lot above, perhaps you'd like a serious answer?

Sentencing guidelines for ABH are on page 17 of this document:
http://www.sentencing...person_accessible.pdf

The sentences quoted there are for first-time offenders, who are convicted after a trial. Previous convictions can push sentencing higher. An early guilty plea can see a reduction in the sentence. (In the case of a custodial sentence that's normally by one third).

As you'll see from that table, your sentence would depend upon whether the court regarded your action as 'pre-meditated'. You should also note that 'operating as part of a gang' can be seen as an aggravating factor, pushing sentencing higher.

Chris
This may or may not be a joke but that are plenty of yobos about Starbuck that act just like this - Brainless individuals. And if it is a joke it's a brainless individual who has posted it.

So a brainless individual joke or not!!!
I though my answer was ok.
Wise posting Chris.

Sometimes though it is hard to be sensible!
So was mine...
..yeah, and mine !
Sorry, Lottie, I should have said he joined yesterday and this is his first question. Is it a real one or a troll?
Many AB'ers have teenage children/grandchildren who are worried about, and cannot be tied to apron strings and this idiot thinks he can come on here and ask for advice about what his stupidity can result in?!
Well said Alba. Whenever the kids go out in a group I am always glad to see them come back safely and they are not even mine!
Don't know Starbuck. Some people find AB just by putting a question like this on the Web. And often first questions are asking questions that are similar to this.
35+ answers and the op has not come back and pleaded his justification nor shown outrage at the answers. I think i will not take this one seriously...
Well I think a gang plotting to beat someone up is premeditated and that would seem to indicate a custodial sentence looking at Chris's link. Anything less than custodial in my opinion would be wrong for this incident!

That is my sensible answer without getting emotional about it.

But who am I to say.
Good idea ttfn. :-)
I don't blame him....I wouldn't come back if I read the answers...

Like Ed says...we're not here to judge.
