Working Time Directive

My boss has drawn up a new contract of employment He states that we have to work to the WTD of 48 hours per week over an average of 17 weeks Monday to Friday. My problem is that, i normaly start work on Sunday, through to Friday. Can somebody tell me if weekend work is excluded from the WTD.

Week end work is the same as any other.... its a lot of hours to be working these days though...and averaging it may mean some weeks you may be well over the limits...

The Working Time Directive operates differently for truck drivers. You need to look at the statute or contact ACAS

Is your boss trying to make sure you conform to WTD, rather than make you work 48 hours / wk

A change of contract has to be agreed by all parties before it is put in place. If your colleagues are in a union consider joining, if they are not in a union, ask them how they would feel about joining one with you. You can join on your own but unions are more effective in numbers. You can also check direct.gov.uk or acas websites for advise.

My OH is a driver, WTD applies differently to you - more governed by your driving hours and statutory breaks, as I understand it.

No, weekend work is included. If he says it is Monday to Friday he is totally wrong.

For truck drivers, the maximim hours excludes breaks and periods of availability (although you might not get any POAs in your type of work).

I don't see why he should have to change your contract in order to comply with the WTD, unless you are already on huge hours and he is cutting them down.
