conflicting information regarding food hygiene

i recently put a question on here asking if a food hygiene certificate was required if a pre-school was selling hot dogs to the general public on sports day. everyone who replied said that a food hygiene certificate was required, however, from other sources I have received conflicting information saying that it is not necessary so now I dont know what to do. my original opinion was that if you were cooking and selling food to the general public you had to have a food hygiene certificate. what is the law on this ??

why dont you try your local council eh dept
Only persons who prepare food 'regularly and frequently', on a commercial basis, are covered by Regulation (EC) No 852/2004 (which is the relevant European Commission regulation embodied within UK law). Others are exempt. That is specifically stated in this document from the European Commission. (Section 3.8):

So persons serving hot dogs at a pre-school sports day do NOT require food hygiene certificates.

sorry, just seen your other question. Same rules as making cakes though.
I make cakes, and I do party catering from home. I am a trained chef so I already have a food hygiene certificate. I called my local council who sent someone round to check my kitchen and home and I was told by him that it was advisable to have a food hygiene certificate. The best thing you could do is call your local council and they will give you all the information you need, alternatively check their website as it should all be on there too.

Why ask on an internet forum where most of us are brain surgeons or highly educated lecturers about food hygiene? Especially given you don't believe any of the information you have received
If you want to sell cakes/bread/sherbet pips and you are being told to get a food hygiene certificate go get one. It's not difficult, it's not expensive and it will save you (and us!) a lot of aggravation

Failing that check out all the links you have been provided with, choose one you like and stick with it
Im a member of a private boat club and we had an open day and sold burgers and hot dogs to the general public and we were informed off the council we didnt need a certificate
Snodhutch - the only people who can tell you for definite is your local council - phone them.
