Whose responsibilty?

My mum has an alley-way along the right hand fence of her garden leading to the car park for residents behind the row of houses. In her garden, right up against the right hand fence, she has two BIG fir-type trees. She keeps them tidy, etc, but the paving in the alley on the other side is terrible! Every slab is lifted one way or another and we're pretty sure its because of the roots of these trees.
My mum moved in to the house last summer and since getting to know the neighbours next door, they've said it's been like that for as long as they can remember. Whose responsibilty is it to sort the path way in the alley? That's just on the assumption that it IS the trees' roots that are the cause...
