Being Mystery Shopped Filmed at Work

Does anyone who works in the field of LAW know whether I am allowed to opt-out of being filmed by a mystery shopper? I have not been asked to sign an agreement to it.

It is totally different to CCTV the camera will be focused on me.

I think your employer should ask you to sign a consent that you accept that the possibility of you being filmed performing your duties is part of your job.

However, with a button cam or similar you may never know ...

I am making the assumption you work in a shop or somwhere similar, which would be classed as a public place.

It is my understanding that any person can film or take photos of what or whomever they want to in a public place so your bosses would not need your permission for this.

Just stick your fingers up to the camera and behave very childishly and they will have to cut you out of the footage. Sorry I can not be of more help but that is what I would do.

Ah yes, mystery shopper comes into the shop and sees assistant sticking his fingers up (they pose as customers you know) instant dismissal for you

If they are going to be obvious with a camera then you will know what they are doing own't you and behave accordingly, but I have a sneaky suspicion you won't have a clue

I think the employer should seek your permission. It may be OK for people to film in a public area but at that point you are not a member of the public who can walk away or swear, you are an employee who has no choice but to be filmed.

The employer most certainly needs your permission to retain the film or to show the film to anyone other than you for training purposes.

Oh dear silly me! I do not want you getting the sack. That is just what I have seen people doing on the streets who do not like cameras on them. Not sure what to suggest now, as am fresh out of ideas.

An employer would have to have some very good reasons to behave as you describe Eddie. And some very tight policy and communication procedures for informing the staff. Its not their right to film staff at work, but it is their right to mystery shop. If this involves filming then they should consult the staff and describe how it will work and who will ahve access to the film etc etc. Doesn't sound as though that's happened to me.

This sounds a bit like recording phone calls for training purposes, I've lost count on how may times I've phoned a company with a query and been told by a pre-recorded message that my call may be recorded for training purposes. Its all to do with Customer Service and although it may seem uncomfortable to you, you probably won't even know its happened because the camera will small and concealed. Your company is making sure that its staff are dealing with customers properly. So just be polite to everyone for a few days and you should have no problems .
