Hello, our new neighbour has completely taken his side of the wall back to plaster and also lodged a piece of wood through our wall... What are our rights please?

He's knows what he has done... He has offered to put the problem right himself... at first we thought ok but then we overheard something (which I don't want to repeat) but wasn't very pleasant, so no way will he be entering our home under any circumstances. If he's offered to put it right I think your legal angle is a non starter.

Why shoud we allow someone who we don't know to do work in our home? We don't know him from Adam... If he is a decent person, he should do the right thing and pay up... I think it requires a professional... I don't particularly want to go as far as legal action...

If you don't want to go for legal action then why have you post.ed this in law? How do you expect to force him to pay if not through legal action. I understand your frustration but am confused at what you want to achieve. If it did go to court and your neighbour says that he offered to rectify the problem the case will be dismissed.

Just want to establish worse case scenario, if neighbour doesn't do the right thing... Just researching all angles... Why would we have to accept his doing the work?? Thank you everyone for all your advice.

Because if you don't then your only recourse is to take it legal. If someone presented me with a bill for something I'd offered to put right my response would be 'see you in court' where my aforementioned scenario is very likely to play out.

I don't fully understand why we have to accept someone we don't know who we don't know is qualified to put right the damage... He could be jack of all trades, master on none... I want someone who is qualified and insured to do the work... Cheers.

I'd at least let him have a go. Making a piece of timber flush with a wall isn't that specialist and form the sake of entent cordial I would peruse this option first.

I'm not sure the Party Wall act covers you if all they are doing is taking their plaster off their side of the wall...
However I do think you should allow them to at least put right the error BEFORE involving someone being paid to do the job... I wouldnt be too happy if presented with a bill I wasnt told about up front when I had offered to put it right myself...

CAS - if a neighbour damaged your pipes and flooded your house and offered to pop round with a mop and some gaffer tape to fix it, would you just accept that?
or would you want to call in a professional plumber to do it properly?

offering to 'put it right' himself is not good enough - as hes clearly not a professional - and actually seems a bit of an idiot and likely to cause more harm than good - what pro would have randomly hammered on a piece of wood, with no thought to the consequences?
a pro would have known better.

you have every right to have the damage rectified by a qualified person...
