can my husband kick me out

When i met my husband he was living in his own flat, the flat we live in now. His name was and still is on the tenancy. Over time he has told me to leave many times and he always wants me gone within a couple of hours. I have gone a few times. We got married 2 years ago. Things are deteriorating and again he is telling me to leave. I asked a friend a while ago and she said the fact that we are married means i do not have to leave. Is this true? Do i have rights?

Marital properties are subject to different regulations than normal tenant-roommate agreements. In most instances, when a property has been deemed marital, it doesn't matter whose name is on the lease.

In most cases, you have a right to reside in the apartment, particularly if there is evidence that your landlord had knowledge of you as a tenant.
you do have 'rights', but why not ensure you have sufficient money and resources, and get your own place? why would you want to stay with a bloke that treats you like that? x

No you do not have to leave and you do have rights. Under the matrimonial homes act 1983 and the family law act 1996 you have the right to occupy the matrimonial home right up to decree absolute and if your husband tries to evict you, court is your remedy.
Your husband may decide to sell the property and it would also be a sensible precaution if you ask the land registry, if the property is registered there, to enter a notice on the file stating you are claiming your right.
yes you have rights to stay..but would you want to ??..I'd be planning my exit...sort out your finances etc first...ie any joint accounts ?..empty them and go
It's not always that easy though. Not everyone has the spare cash to leave within a few hours.

Sounds like this is his weapon he uses when they fall out. Now she knows she can tell him to get stuffed.

I had a friend in a near identical situation.
She stuck it as long as she could but in the end she was glad to move out.
It was his house and they were married for around 2 years. I think after legal wrangling, her ex had to pay her £5,000

Thanks for pointing out it is a tenancy Mrs O, my answer was also based on the husband owning the property, you still do not need to move out though.
