WHAT AM I ENTITLED TO WHEN GETTING DIVORCED
5 Answers
Hi All,
Hope you can advise....
My friend is in a predicament and has asked for my advise, so i have turned to you good people who always seem to put me in the right direction with any questions I've had in the past.
My friend is 48 years old, been married for 30 years. She has 3 children to her husbnd. He has been proven to be having an affair. When my friend confronted him about the affair he has resorted to head games by saying that my friend is "cracking up", "paranoid" and that she needs to see a doctor etc...
Apart from the marital history between them i.e. 30 years of marriage and a family together, the only drawback is my friends name is not on the mortgage which they moved in to the property together from the very first day they received the keys for the house. Is my friend entitled to half of the house, half of what they have together etc. Where does my friend stand with this situation?
Any advise much appreciated.

As they have been married for 30 years she is entitled to half the property, even though her name may not be on the mortgage.
If the children are still under 18 and living at home (doubtful) she may be able to stay in the house with the children.
